1 Introduction and acceptance
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and MWAH LLC, a Delaware limited liability company doing business as MWAHoriginals ("we", "us", "our", or "Company"), governing your access to and use of the ColorBOXZ.com website and all associated services (collectively, the "Platform"). By accessing, browsing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.
2 Platform description
ColorBOXZ.com is a book publishing and sales platform that offers digital books, print-on-demand books, and related products. The Platform hosts books published by the Company as well as books from third-party authors who list their works through our marketplace.
3 User categories and access tiers
3.1 Visitors
Unregistered visitors may browse the Platform and preview limited pages of listed books (up to 20 pages per title). Visitors cannot make purchases or download content.
3.2 Registered users
Users who register a free account may access extended browsing privileges and download free content when offered. Registration requires the provision of verifiable and accurate information, including full legal name, valid email address, and telephone number.
3.3 Members
Membership is free and available to all Registered Users. Members enjoy full browsing privileges and may purchase digital and print-on-demand products through the Platform.
4 Account registration and security
To register an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account. You must notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in fraudulent activity.
5 Purchases and payment
5.1 Payment processing
All transactions are processed through PayPal. By making a purchase, you agree to PayPal's terms of service in addition to these Terms. We do not store credit card or bank account details on our servers.
5.2 Pricing and currency
All prices are displayed in US Dollars unless otherwise indicated. Prices are subject to change without notice. The price at the time of purchase confirmation applies to your order.
5.3 Digital products – no refunds
Due to the nature of digital content, all sales of digital products are final. No refunds will be issued once a download has commenced or access has been granted, except in cases of proven technical corruption of the file that prevents viewing. Users are encouraged to use the preview function (when a Registered Member, cab be up to 20 pages) to make an informed purchasing decision before completing any transaction.
5.4 Print-on-demand products
Print-on-demand books are shipped directly to the purchaser from our fulfilment partner unless otherwise specified. Optional tracking and insurance may be selected at checkout.
5.5 Risk of loss
The risk of loss and title for such items pass to you upon our delivery to the carrier. If tracking and insurance are selected, the item may be routed through our facility, resulting in longer delivery times. Refunds for damaged or lost print items will be handled on a case-by-case basis and will require evidence of damage (by photo) or non-delivery. Any return costs will be the responsibility of the purchaser.
6 Geographic restrictions
The Platform primarily serves users in English-speaking markets: the United States, Canada, the United Kingdom, Australia, New Zealand, Singapore, and India. We do not sell to or accept orders from users located in the People's Republic of China, the Russian Federation, the Democratic People's Republic of Korea (North Korea), the Islamic Republic of Iran, or the Republic of Belarus. We further do not sell to any jurisdiction where PayPal services are unavailable or where such sale would violate applicable export controls or sanctions.
7 Age requirements and parental responsibility
7.1 General age requirement
You must be at least 18 years of age to create an account, make purchases, or access age-restricted content. Users between 13 and 17 years of age may access the Platform only with verifiable parental or guardian consent.
7.2 Age-restricted content
Certain content on the Platform, including but not limited-to titles in the HEALTH TRUTH series dealing with sexual health, is restricted to users aged 18 and over. Access-to and purchase-of such content requires affirmative confirmation that you are 18 years of age or older.
7.3 Parental responsibility
Parents and guardians are solely responsible for supervising their children's access to the Platform and for any purchases made through their accounts by minors. We are not liable for purchases made by minors using a parent's or guardian's PayPal account without authorisation.
8 Intellectual property
8.1 Platform content
All content on the Platform, including but not limited to text, graphics, logos, images, and software, is the property of MWAH LLC or its content suppliers and is protected by applicable copyright, trademark, and other intellectual property laws.
8.2 User licence
Upon purchase of a digital product, you are granted a limited, non-exclusive, non-transferable licence to access and use the purchased content for personal, non-commercial purposes. You may not copy, distribute, modify, publicly display, or create derivative works from purchased content without express written permission.
8.3AI training prohibition
You are strictly prohibited from using, downloading, or "scraping" any content from the Platform for the purpose of training machine learning or artificial intelligence models without express written consent from the Company.
8.4 User reviews
By posting reviews or feedback, you grant us a royalty-free, perpetual, irrevocable right to use, reproduce, and display such content in connection with the Platform.
9 Third-party author content
The Platform hosts books from third-party authors. Whilst we endeavour to review submissions before publication, we do not warrant, endorse, or assume responsibility for the accuracy, legality, or appropriateness of third-party content. Authors warrant that they hold all necessary rights to content they submit, and they indemnify us against claims arising from their content. We reserve the absolute right to refuse, remove, or modify any third-party content at our sole discretion and without notice or explanation.
10 Copyright infringement and dmca
We respect intellectual property rights and expect users and authors to do the same. If you believe content on the Platform infringes your copyright, you may submit a notice to our designated copyright agent containing: identification of the copyrighted work, identification of the infringing material, your contact information, a statement of good faith belief, a statement of accuracy under penalty of perjury, and your physical or electronic signature. Upon receipt of a valid notice, we will expeditiously remove or disable access to the allegedly infringing content and notify the content provider. Repeat infringers will have their accounts terminated.
11 Prohibited conduct
You agree not to: use the Platform for any unlawful purpose; attempt to gain unauthorised access to any portion of the Platform; interfere with or disrupt the Platform's operation; upload or transmit viruses or malicious code; scrape, harvest, or collect user data; circumvent any content protection measures; resell, redistribute, or commercially exploit purchased content; or impersonate any person or entity.
12 Privacy and data collection
12.1 Data collection and protection
We collect and process personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. All user data is encrypted during transmission and storage. We do not sell, rent, or share your personal data with third parties for their marketing purposes.
12.2 Promotional communications
By registering an account, you consent to receive transactional emails related to your purchases, account activity, and Platform updates. You may also opt in to receive promotional communications, including newsletters, new release announcements, and special offers. You may unsubscribe from promotional communications at any time by clicking the "unsubscribe" link in any such email or by updating your account preferences. Unsubscribing from promotional communications will not affect transactional emails necessary for Platform operation.
13 Disclaimer of warranties
The platform and all content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, secure, or error-free.
14 Limitation of liability
To the maximum extent permitted by law, mwah llc and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability for any claim arising from or relating to these terms or the platform shall not exceed the amount you paid to us in the twelve months preceding the claim.
15 Indemnification
You agree to indemnify, defend, and hold harmless MWAH LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: your use of the Platform; your violation of these Terms; your violation of any third-party rights; or any content you submit to the Platform.
16 Dispute resolution
16.1 Informal resolution
Before initiating formal dispute resolution, you agree to contact us and attempt to resolve any dispute informally for at least thirty (30) days.
16.2 Binding arbitration
Any dispute not resolved informally shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in English and seated in Delaware, United States. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
16.3 Small claims exception
Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within that court's jurisdictional limits (generally claims under USD 10,000).
16.4 Injunctive relief
Nothing in this section shall prevent either party from seeking injunctive or other equitable relief from the courts for matters related to intellectual property rights or unauthorised access to the Platform.
16.5 Class action waiver
You and mwah llc agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
17 Governing law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
18 Modifications to terms
We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms on the Platform with a revised "Effective Date". Your continued use of the Platform after such changes constitutes acceptance of the modified Terms.
19 Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and dispute resolution provisions.
20 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
21 Entire agreement
These Terms, together with our Privacy Policy and any applicable Author Agreement, constitute the entire agreement between you and MWAH LLC regarding your use of the Platform and supersede all prior agreements and understandings.
22 Acknowledgement
By using the platform, you acknowledge that you have read these terms of service, understand them, and agree to be bound by their terms and conditions.
